Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Mallow Market mobile application ("Mallow", "the App", "we", "us"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The Service

Mallow is an invite-only, mobile-first marketplace that lets people discover, buy, and sell secondhand items with nearby neighbors. The App provides GPS-based discovery of listings, in-app chat between buyers and sellers, and optional seller subscription plans described below. Mallow is a venue that connects buyers and sellers — Mallow is not a party to any transaction between users, does not take a commission on sales, and does not handle payment or delivery for items bought or sold through the App.

2. Eligibility and Accounts

Mallow is currently invite-only: a valid invite code is required to create an account. You must provide accurate information when creating your account and are responsible for activity that occurs under it. You must be able to form a binding contract in your jurisdiction to use the App.

3. Seller Subscription Plans

Selling on Mallow is free of charge — every seller can list items with no plan at all, subject to the listing limit below. Optional paid plans raise that limit. All plans are billed monthly; there is no annual billing option. As required by Apple App Store Review Guideline 3.1.2, the plans, their price, duration, and auto-renewal terms are set out here in full.

"Active listing limit" means the maximum number of listings you may have with status ACTIVE (i.e. currently for sale, not sold or removed) at the same time. It is not a lifetime cap: marking an item as sold or deleting a listing immediately frees up a slot.

Auto-renewal

Plus and Pro subscriptions are auto-renewing and billed monthly. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews for the same price and duration unless you cancel it at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription at any time by going to your device's Settings app → your Apple Account name → Subscriptions, and selecting Mallow Market. Cancelling a subscription does not issue a refund for the current billing period already paid for — you keep the plan's benefits until the end of that period.

What happens if your plan lapses or you downgrade

Listings you already have that are ACTIVE are never deleted because your subscription lapses or you downgrade. If, at the moment your plan changes, you have more ACTIVE listings than your new plan allows, the listings above your new limit are set to an inactive state and hidden from search results — they are not deleted, and you can reactivate any of them at any time, up to the number your current plan allows. The only other effect of exceeding your plan's limit is that you cannot create a new listing until your ACTIVE listing count drops below your plan's limit (by selling or removing a listing, or reactivating fewer than your limit allows) or you upgrade to a plan with a higher limit.

4. Acceptable Use

You agree not to use Mallow to:

• List items that are illegal to sell, stolen, counterfeit, or that infringe on the intellectual property rights of others;
• Post false, misleading, or fraudulent listings or communications;
• Harass, threaten, or abuse other users, including through chat messages;
• Attempt to circumvent invite-only access controls or share invite codes for commercial gain;
• Interfere with or attempt to disrupt the App or its underlying infrastructure, including by automated scraping or abuse of the API;
• Impersonate another person or misrepresent your affiliation with any person or entity.

5. User Content

You retain ownership of the listings, photos, messages, reviews, and other content you submit to Mallow ("User Content"). By submitting User Content, you grant Mallow a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely for the purpose of operating and providing the App to you and other users (for example, showing your listing photos to nearby buyers). You are solely responsible for the accuracy and legality of your User Content. We may remove content that violates these Terms.

6. Reviews and Ratings

After a completed transaction, buyers and sellers may leave a rating and written review of each other. Reviews must be honest accounts of your own experience. Reviews cannot be edited or deleted once submitted.

7. Voice-to-Listing Feature

Mallow offers an optional feature that lets you describe an item by voice instead of typing. If you use this feature, your voice recording is sent to our backend, which uses third-party AI services to transcribe and process it into listing fields (see our Privacy Policy for details on this data transfer). Use of this feature is optional and you can always type your listing details instead.

8. Termination

You may stop using the App at any time. You can delete your own account from Profile > Settings > Delete Account, after confirming your password. Deletion is immediate and irreversible: there is no recovery period, and we cannot restore a deleted account. See our Privacy Policy for exactly what is removed and what is retained (for example, reviews and messages involving other users are kept, but no longer show your name).

Deleting your account does not cancel an active Plus or Pro subscription purchased through the App Store — Apple continues billing until you cancel it yourself in your device's Settings. Cancel your subscription before deleting your account if you no longer want to be charged.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behavior, or if required by law. Where reasonably possible, we will provide notice before termination. Provisions of these Terms that by their nature should survive termination (including Sections 5, 9, and 10) will survive.

9. Disclaimers and Limitation of Liability

Mallow is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee the accuracy of listings, the conduct of other users, or that the App will be uninterrupted or error-free. Mallow is not responsible for the quality, safety, legality, or delivery of items listed, bought, or sold through the App — transactions and any in-person exchange happen directly between users, at their own risk. To the maximum extent permitted by applicable law, Mallow's total liability arising from your use of the App is limited to the amount you paid us, if any, in the twelve months preceding the claim.

10. Governing Law

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence within the European Union.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the App. Continued use of Mallow after changes take effect constitutes acceptance of the revised Terms.
